Under both Federal laws and the state of Maryland laws, a child is entitled to the same quality of education as any other student—regardless of their situation. The Individuals with Disabilities in Education Act (IDEA) governs all aspects concerning the education of children and adults between the ages of 3-21 with identified disabilities. Some of the recognized disabilities include:

  • Blindness
  • Brain Injury
  • Autism
  • Hearing Impairment
  • Mental Retardation
  • Emotional Disturbance
  • Speech or Language Impairment
  • Orthopedic Impairments
  • Attention Deficit Disorder (ADD)
  • Attention Deficit Hyperactivity Disorder (ADHD)

Under the IDEA Act, a public school is required to do the following:

  1. Identify children who have known or suspected disabilities
  2. Develop a behavior modification plan or create an individual education plan (IEP)
  3. Begin to utilize the behavior modification plan or IEP and to monitor the student’s progress in achieving the specified goals
  4. Revise and make changes to the plan as necessary or at least annually
  5. Find an appropriate placement for the student in question

Our attorneys are well-versed in these Special Education laws and how they should be implemented. For instance, children with disabilities are required to have what is known as a Free Appropriate Public Education (FAPE). These children are able to receive the following services under FAPE:

  • Specialized Instruction
  • Occupational Therapy
  • Inclusion Instruction
  • Modifications in the regular education setting
  • Physical Therapy
  • Speech and Language Therapy
  • Adaptive Physical Education
  • School based counseling or social skills training
  • Modifications in the regular education setting
  • Instruction using Applied Behavior Analysis methodology

  • Transportation to and from school

  • Liaise with your child’s school and Special Education team to ensure that your child is receiving  all of their educational rights under the IDEA Act (see above section regarding your child’s rights and benefits under the IDEA Act)
  • If your child’s situation is not being solved in a timely manner, we will ask for Mediation in order to resolve any conflict (i.e. the school system is not providing your child with the necessary services under FAPE)
  • If Mediation is not successful, we will file a Due Process action with the county and/or state to address the specific violations under the IDEA Act
  • Assist you in understanding what rights and responsibilities you have as a parent of a special needs child
